TL;DR: what's available right now (updated October 12, 2026)
- No TCUP card needed for hemp-derived THC gummies, edibles, drinks and tinctures. They remain legal in Texas for adults 21 and over, and we carry them.
- On hold: We are awaiting the next court decision on THCa in Texas. Until then we do not sell THCa flower, pre-rolls or concentrates in Texas.
- Federal change ahead: a new federal hemp definition takes effect December 11, 2026, measuring total THC and capping finished products at 0.4 mg total THC per container. None of the bills to change it has passed.
Legal update: August 25, 2026
Texas law changed after this article was written. On July 31, 2026 the Texas Department of State Health Services moved delta-8 THC, delta-10 THC, delta-6 THC and THCP onto the state Schedule I list. Austin police have said possession will be charged as a state jail felony.
THCa was not scheduled. It is off the Texas market for a different reason: DSHS rules effective March 31, 2026 fold THCa into the THC calculation as total THC, and the Fifteenth Court of Appeals lifted the injunction against those rules on June 5, 2026. High-THCa flower cannot pass that calculation, so it no longer meets the definition of legal hemp in Texas.
Still legal for adults 21 and over: hemp products containing no more than 0.3% THC by dry weight. That covers the gummies, seltzers, sodas and tinctures we deliver. CBD, CBG and CBN products are unaffected.
We have taken THCa flower, pre-rolls and concentrates out of stock while the Texas Hemp Business Council's appeal is pending (Case No. 15-26-00099-CV). Anything below that describes THCa or delta-8 as available in Texas reflects the law as it stood in April 2026.
Short answer: no, you don't need a TCUP card to buy THC in Texas. TCUP (Texas Compassionate Use Program) is the state's medical cannabis program — it's one path to THC, but federally legal hemp-derived THC products are sold to adults 21+ at retail without any prescription, registry enrollment, or qualifying medical condition.
What TCUP Actually Is
TCUP requires a physician prescription entered into the Compassionate Use Registry of Texas. To buy from a licensed TCUP dispensary, you need:
- Permanent Texas residency
- A qualifying condition (chronic pain, PTSD, cancer, epilepsy, MS, ALS, autism, Crohn's, TBI, terminal illness, hospice — list expanded by HB 46 in 2025)
- A prescription from a CURT-registered physician (typically $150-$300 out of pocket for the consult)
- 1-3 weeks to complete the process before you can order
If that fits your situation, TCUP gives you access to clinical-grade products with physician oversight. The dose cap is now 10mg THC per dose and 1,000mg per package after the HB 46 expansion.
The Hemp Retail Path
The 2018 federal Farm Bill legalized hemp products containing less than 0.3% THC by dry weight. Texas implemented this through HB 1325 in 2019. Under both federal and state law, hemp-derived THC products — including 10mg gummies, THC seltzers, and tinctures — are sold legally at retail in Texas.
What you actually need to buy hemp THC in Texas:
- Be 21 or older
- Show ID at checkout (online or in-store)
- Live somewhere we ship to (Texas + most other US states)
That's it. No prescription. No registry. No qualifying condition. Same-day pickup or delivery in many Texas markets.
Why So Many Texans Choose Hemp Over TCUP
- Speed: Same-day vs 1-3 weeks
- Cost: Skip the $150-$300 doctor visit
- Variety: Hemp retailers carry THC seltzers, edibles and tinctures. THCa flower and pre-rolls are not currently sold in Texas while we await the next court decision on THCa. TCUP is mostly tinctures, gummies, lozenges, and limited inhalables
- Access: TCUP-licensed dispensaries are concentrated in central Texas. Hemp retail is everywhere
- No qualifying condition needed: If you don't have a TCUP-qualifying diagnosis, hemp is your only legal path
What About the Smokable Hemp Ban?
A Texas smokable hemp ban took effect March 31, 2026. A Travis County district judge temporarily blocked the ban in April 2026, but that injunction has since been lifted, and THCa flower and pre-rolls are not currently sold in Texas while we await the next court decision on THCa. Edibles, drinks, and tinctures are not affected: they remain legal under the 0.3% THC dry-weight rule.
What Counts as "Hemp THC" Legally?
Any cannabis product where the finished item contains less than 0.3% THC by dry weight is hemp under federal and Texas law. Practically, this means:
- 10mg THC gummies (a few mg of THC in a 4g+ gummy)
- Hemp-derived THC seltzers and beverages
- THC tinctures dosed for sublingual use
- THCa flower previously qualified (the unheated flower passed the dry-weight test), but it is not currently sold in Texas while we await the next court decision on THCa
Decide Quickly
If you have a serious medical condition and want clinical oversight, look at TCUP — it's broader than ever after HB 46. For everyday use, hemp retail is faster, cheaper, more available, and federally legal under the 2018 Farm Bill.
