On July 31, 2026 Texas moved delta-8, delta-10, delta-6 and THCP onto Schedule I. THCa was not scheduled, but a separate DSHS testing rule now takes high-THCa flower outside the definition of legal hemp. Hemp delta-9 THC at or under 0.3% by dry weight stays legal.
